VAT Refunds for Businesses Based Outside the UAE

VAT Refund for Foreign Business

A VAT refund for a foreign business in the UAE is not something most companies outside the country know exists. With no establishment here and no UAE VAT registration, the 5% on every UAE invoice has probably been written off as a cost of trading.

For many, it is recoverable through a scheme with its own eligibility test, its own documents, and the part that catches people, its own annual window.

This is a scheme for companies reclaiming VAT on UAE business costs. It is not the tourist refund on personal shopping, which is a separate process with separate rules and nothing in common with this one beyond words.

Who the Scheme Is For

This is not the route a UAE-registered company uses to recover excess input tax that runs through the VAT return, covered in our guide to claiming a VAT refund in the UAE. This scheme is for businesses not in the UAE system at all. The Federal Tax Authority sets five conditions, and all must apply:

  • You have no place of establishment or fixed establishment in the UAE or in any implementing state
  • You are not a taxable person in the UAE
  • You are not carrying on business in the UAE
  • You carry on a business and are registered as an establishment with the competent authority in your own country
  • Your country refunds VAT to UAE entities in similar circumstances

The second and third look like the same test and are not. A business can fall below UAE registration thresholds and still be carrying on business here outside this scheme despite not being a taxable person. If you have UAE activity beyond incurring costs, check that distinction first.

Reciprocity Is the Condition to Check First

The last condition decides everything and is the one most businesses never check: the UAE refunds VAT to foreign businesses whose own countries do the same for UAE entities.

If your country is not on the approved list, the route runs from your own Ministry of Finance to the UAE Ministry of Finance, not a two-week conversation. Confirm reciprocity before spending anything.

The Window, the Floor and the Clock

Applications are accepted from 1 March to 31 August each year. Outside those six months, the scheme is closed, and the next chance is twelve months away.

  • Each claim covers one calendar year, with an exception for applicant’s resident in a GCC state that is not an implementing state
  • The minimum claim is AED 2,000 of VAT below that; there is nothing to file
  • Processing estimates differ across FTA pages 40 working days on the service listing, four months from receipt of the original documents in the Business Visitors guidance

Plan on the longer. Original documents must reach the FTA in hard copy, and the clock runs from their arrival, not your online submission.

The Document That Decides Whether You File at All

Most of the paperwork can be scanned. One cannot.

You must submit an original Tax Compliance Certificate a business status certificate, certificate of commercial activities or equivalent issued by your country’s tax administration, in Arabic or English, showing your tax registration number, and attested by the UAE Embassy in the country where you are tax registered.

How long attestation takes varies by country and sits outside your control. It is the most common reason a business that starts in February does not file that year.

What Else Goes In

  • Tax invoices showing a valid TRN, an incorrect number is rejected, not queried
  • Proof of payment for each invoice; a receipt, or an invoice stamped paid showing the supplier
  • Proof that the authorised signatory is authorised, plus their passport
  • A declaration of your recoverable input tax percentage, if you have exempt or non-business activities at home

The invoice condition is where value quietly disappears. A year of UAE invoices collected casually will contain some with a missing or wrong TRN, and those amounts drop out of the claim.

Why This Is an October Problem, Not a March One

The window opens on 1 March 2027. Working backwards: request the certificate, have it attested at the UAE Embassy, gather a year of invoices, check every TRN, re-request the bad ones from suppliers, and match payment evidence to each.

Months of elapsed time, against a hard close on 31 August. Businesses treating it as a March task spend March discovering what they should have started in November.

Frequently Asked Questions

Who can claim a VAT refund as a foreign business in the UAE?

A business with no place of establishment or fixed establishment in the UAE or an implementing state, not a taxable person here, not carrying on business in the UAE, registered as an establishment with the competent authority in its own country, and whose country refunds VAT to UAE entities in similar circumstances. All five must be met.

When can I apply?

Between 1 March and 31 August each year. The scheme is closed outside that window, and each application covers one calendar year.

Is there a minimum claim amount?

Yes, AED 2,000 of VAT. Claims below that cannot be submitted, so total your UAE input VAT before starting.

How long does the FTA take to process it?

FTA pages differ: 40 working days on the service listing, four months from receipt of the original documents in the Business Visitors guidance. Plan on the longer, and note the clock starts when the hard copies arrive.

Which requirement causes the most delay?

The Tax Compliance Certificate. It must be an original, issued by your own tax administration and attested by the UAE Embassy in that country, and the timeline is not something you control.

Is this the same as the tourist VAT refund at the airport?

No. That is a separate scheme for individual visitors on personal purchases. This one is for companies reclaiming VAT on UAE business costs, with different conditions and its own annual deadline.
